Matt Elkins

I am the director of Legisia and I am a leading solicitor in my field, specialising in the deletion of Police Records and Disclosure and Barring Service (DBS) cases. 

I have successfully applied for the deletion of police records for hundreds of clients – expunging police cautions and other OOCDs, arrest records, and local police records. I have also successfully appealed many enhanced DBS Certificates and Barring cases. 

Along with applying for the deletion of police records, I am also called upon to obtain records held by public bodies under the Data Protection Act 2018, and also to apply for deletion/rectification of records. 

I also have experience of appealing wrongful convictions to the Criminal Cases Review Commission (CCRC).  In addition I assist victims of crime in filing allegations with the police, and also provide representations under the “right to review” scheme where the police or CPS have declined to prosecute. 

I am also able to help with disciplinary proceedings for health care professionals, particularly were these relate to criminal allegations. 

Prior to specialising in criminal records, DBS proceedings and related matters, I was a practicing criminal defence lawyer, becoming a partner at a leading niche City of London criminal defence firm.  This extensive coal face experience gives me a full insight into the criminal investigation process that is essential when handling police records cases, DBS cases, and also disciplinary proceedings. 

Prior to qualifying as a solicitor I was also previously a gradate teaching assistant at the University of Geneva, teaching public international law and human rights during emergency situations.

I am the author for Westlaw’s practice note on police cautions, I have had an article published in the Criminal Law Review on reform to the police caution regime, and also an article published in the the Criminal Law and Justice Weekly on Anonymity in Criminal proceeding. I also created, and maintain, the DBS Barring Law Database.   

  

My Experience

I have successfully represented clients in hundreds of record deletion & DBS cases 

I have dealt with many police records over the years, having local records, simple cautions, youth reprimands and warnings, youth simple cautions, and conditional cautions expunged.

Examples of cases where I have successfully had records expunged include Actual Bodily Harm (ABH) cases, common assault, child neglect and cruelty, possession of cannabis, possession of cocaine, possession of MDMA powder, possession of Ecstasy, possession of MCAT (Mephedrone), possession of Indecent images, grievous body harm (GBH), assault by beating, soliciting, indecent assault, sexual assault, abuse of a position of trust, assaulting a police officer, assaulting an emergency worker, drunk and disorderly, criminal damage, arson, theft, fraud and related offences, unlawful sale of medicines, being drunk in charge of a child in public, possession with intent to supply class A, B and C drugs, racially aggravated assault and public order offences, harassment (with and without threats of violence), stalking, election offences, public order offences including section 4 and 5 Public Order Act offences and affray, outraging public decency, indecent exposure, voyeurism, firearms/shotgun offences, sexual activity with a child, sale of steroids, malicious communications and related offences, the possession of a pepper spray (technically a firearm) and other allegations.

Along with challenging locally held or PNC records, I have challenged a wide variety of DBS cases. I am often able to stop information being disclosed on enhanced DBS certificates as well as resisting DBS barring cases.

Along with challenging or obtaining records, I am often instructed to  apply for records under the Data Protection Act 2018/GDPR held by public bodies, and also to apply for the rectification or erasure of records.  

Many of my clients are also regulated professionals, and so I have also developed knowledge and experience in dealing with regulators and disciplinary proceedings.
