Old ABH Caution Removed Before China Visa Application
The Situation:
What Our Client Was Facing
Our client was planning to move to China to join his wife and was increasingly worried about what might appear on overseas police checks. What had once felt like long-buried student-era incidents were now threatening to become a serious barrier to immigration, employment and future stability.
The first problem was an old police caution for ABH dating back to his university years. The incident arose out of a nightclub fight in which the injuries to the other party were serious, including broken teeth, but our client had maintained that he had acted in self-defence. He was young, had no solicitor, and ultimately accepted the caution because he feared prosecution and thought it was the safest way to avoid court.
The second problem was a later arrest in connection with an arson investigation. CCTV had picked up his car in the area, and he was arrested as part of the enquiry even though he had nothing to do with the incident. He had a proven alibi, the allegation was false, and he was never responsible for the offence — but he was still deeply concerned about the arrest record and what it might mean in practice.
Both matters were now causing immediate anxiety because of the move to China. As our guide on whether a police caution shows on an ACRO Police Certificate explains, a caution of this kind can continue to affect overseas immigration and certificate outcomes if it remains on record. Our client was also concerned about future teaching roles, where safeguarding checks such as an ICPC could create a separate problem altogether.
NEED HELP WITH A CAUTION OR ARREST RECORD AFFECTING OVERSEAS PLANS?
Our Approach:
How We Challenged the Caution
We approached the matter as an overseas-disclosure problem built on two separate record issues. The old ABH caution was the main long-term barrier, but the later arrest record also mattered because our client needed as much clarity as possible before immigration and teaching-related checks abroad.
- We revisited the ABH caution in detail: The police record did not show a clear and reliable admission of unlawful violence. Instead, it showed that our client had maintained a self-defence position, but ultimately accepted the caution when he was young, unrepresented and afraid of being prosecuted.
- We focused on the absence of a proper admission: That point was critical. A caution should not be treated as safe simply because someone eventually signs for it, especially where the surrounding record shows denial, self-defence, pressure and fear of prosecution rather than a clear informed acceptance.
- We dealt with the later arson arrest separately: In relation to the arrest record, we were able to show that the allegation was false and that our client had a proven alibi.
- We linked both records to the overseas risk: We set out the real impact on China immigration and the additional concern about teaching roles abroad, where the difference between an ACRO Police Certificate and an ICPC could become important. Our guide on ICPC vs ACRO Police Certificate explains why those distinctions matter.
- We prepared structured legal representations: We made formal submissions explaining why the ABH caution should be deleted from the PNC and why the later arrest record should also be removed given the false allegation and established alibi.
This was not just a case about old records being inconvenient. It was a case about an unsafe caution accepted without a proper admission, a false arrest that should not have continued to cast a shadow, and the very real risk of both records derailing an international move and future work abroad.
The Outcome:
How Legisia Protected & Reinstated Client's Life
The ABH caution was deleted from the Police National Computer, and the later arrest record connected to the arson investigation was also removed. That cleared away the two police record problems that had been threatening our client’s plans to move to China and rebuild his life there.
For our client, the result was critical. An old student-era caution accepted without a proper admission, together with a later false arrest, no longer remained capable of damaging his immigration prospects, overseas employment or future teaching-related checks.
Instead of being held back by records that should not have remained in place, he was able to move forward with his wife and future plans on a properly corrected footing.

Why This Case Mattered — and What Others Can Learn
This case shows why overseas plans often expose police record problems that people assumed had faded away. An old caution or a later arrest record can suddenly become decisive when immigration, overseas employment or safeguarding checks come into view.
It also shows that age is not the same as safety. A caution may still be removable many years later if the underlying record shows that there was never a proper admission, while an arrest record may also be challengeable where the allegation was false and an alibi was always available. Early legal advice matters most where international opportunities depend on getting the record position right before applying.
If an old caution or arrest record is affecting your overseas plans, Legisia’s Police Caution Removal service can assess whether there is a realistic basis to act.
Q&A
Can an old ABH caution affect a China visa or overseas move?
Yes. If the caution remains on police systems, it can affect ACRO Police Certificate disclosure and create wider immigration or overseas employment concerns.
Can a caution be removed if I accepted it because I feared prosecution?
Potentially, yes. Where the police record does not show a clear and proper admission, and instead shows denial, self-defence or acceptance driven by fear of prosecution, there may be grounds to challenge the caution under the Record Deletion Process.
